Terms of Service

By accessing or using SecureCheap ("Service"), creating an account, or clicking "I agree", you accept these Terms of Service in full. If you disagree with any part, you must not use the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

You must be at least 18 years old and capable of forming a binding contract under applicable law. You agree to provide accurate, current, and complete information during registration and to keep that information updated.

You are responsible for safeguarding your account credentials and for all activities under your account. Notify us immediately of any unauthorised use at [email protected].

We reserve the right to suspend or terminate accounts that violate these Terms, with reasonable notice except in cases of suspected abuse, fraud, or security incidents.

The Service is offered on a subscription basis (Free, Starter, Pro, Enterprise). Paid subscriptions are billed monthly or annually in advance. Fees are non-refundable except as required by applicable law or expressly stated in these Terms.

You authorise us to charge your chosen payment method for all fees. Failed payments may result in service suspension after a 7-day grace period with email notification.

You may cancel at any time from the billing dashboard. Cancellations take effect at the end of the current billing period — there are no early-termination fees.

Price changes will be communicated at least 30 days in advance and apply at your next renewal.

You agree NOT to use the Service to monitor systems you do not own or have explicit authorisation to monitor; attempt to gain unauthorised access to any part of the Service; transmit malware, conduct DDoS attacks, or interfere with the Service or its infrastructure; resell or commercially redistribute the Service without our written consent; reverse engineer, decompile, or attempt to extract source code, except as permitted by law.

Violation of this policy may result in immediate account suspension or termination, and we may report illegal activity to law enforcement.

You retain all rights to data you submit through the Service ("Customer Data"). You grant SecureCheap a limited licence to process Customer Data solely to provide and improve the Service.

We will not access, view, or use Customer Data except (a) as necessary to operate the Service, (b) to comply with legal obligations, (c) to respond to support requests you initiate, or (d) with your express permission.

You can export all Customer Data via the API or dashboard at any time. After account termination, we delete Customer Data within 30 days unless legally required to retain it.

Paid plans include a target uptime SLA: Pro plan 99.95%, Enterprise plan 99.99% per calendar month, excluding scheduled maintenance announced at least 48 hours in advance.

If we fail to meet the SLA, you are entitled to service credits as documented in your subscription agreement, applied to your next invoice automatically — you do not need to request them.

SecureCheap, the SecureCheap logo, the Service software, documentation, and all related intellectual property are owned by SecureCheap or its licensors and are protected by copyright, trademark, and other laws.

You may not copy, modify, distribute, sell, or lease any part of the Service or included software, nor reverse engineer or attempt to extract source code, unless laws prohibit those restrictions or you have our written permission.

The Service is provided "AS IS" and "AS AVAILABLE". To the maximum extent permitted by law, SecureCheap disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure, nor that any defects will be corrected. Nothing in these Terms affects statutory rights that cannot be excluded.

To the maximum extent permitted by applicable law, SecureCheap and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.

Our aggregate liability for any claim arising from or related to the Service shall not exceed the greater of (a) the amounts paid by you in the 12 months preceding the claim, or (b) USD 100.

Some jurisdictions do not allow limitations on implied warranties or exclusions of certain damages — these limitations may not apply to you in full.

You agree to indemnify and hold harmless SecureCheap from any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from (a) your use of the Service, (b) your violation of these Terms, (c) Customer Data you submit, or (d) your violation of any third-party right.

You may terminate your account at any time from the dashboard. We may terminate or suspend access immediately if you materially breach these Terms, with notice except where notice would compromise security or fraud prevention.

Upon termination, all rights granted to you cease. Provisions that by their nature should survive termination (intellectual property, disclaimers, liability limits, indemnification, dispute resolution) will survive.

These Terms are governed by the laws of the Dubai International Financial Centre (DIFC), without regard to conflict of laws principles. Any disputes will be resolved exclusively in the DIFC Courts.

You agree to first attempt resolution informally by contacting [email protected]. If unresolved after 60 days, disputes may proceed to formal proceedings.

We may revise these Terms from time to time. Material changes will be notified by email to the account owner at least 30 days before taking effect. Continued use after the effective date constitutes acceptance.
